Public offer (rules)
1. Terms and definitions:
1.1. "clikmanbux.com" is a website on the Internet (hereinafter referred to as the "Project" or "Website") that provides Users, under the terms of this user agreement, with the opportunity to place orders for the performance of work (provision of services, execution of tasks) and (or) accept the specified orders for execution under the terms determined by agreement between the Customer and the Contractor. Neither the owner of "clikmanbux.com" nor the Site Administration may under any circumstances act as either the Customer or the Contractor, being exclusively intermediaries between the said persons.1.2. "Account" - an identification record assigned to each User, containing information about the User, payment details, statistics, balance of funds and other data.
1.3. "User" - a person who has accepted this public offer by registering on the Site "clikmanbux.com"
1.4. "Advertiser" ("Customer") - User placing an order using the Site "clikmanbux.com".
1.5. “Contractor” – the User fulfilling an order or part of it, placed by the Advertiser on the Site.
1.6. "Referral" - a User invited by another user to the Project using a unique referral link.
1.7. "Referrer" - a User who has invited other users to the Project using a unique referral link.
1.8. "Authentication and authorization" ("Account Login") - gaining access to the Account by entering identification data (username/email and password, WMID token, social network token, API key, etc.) on the website "clikmanbux.com".
1.9. "Ban" - blocking of the User Account, excluding the possibility of authentication and authorization and any actions by the user through his/her Account.
2. General provisions
2.1. By registering on the Site, the User unconditionally accepts and follows all the points of this offer.2.2. The Administration has the right to unilaterally and at any time make changes to this public offer by posting a new version of it in full on the Site https://clikmanbux.com/publichnaya-oferta. The new version of the offer comes into force from the moment of its publication.
2.3. Additional rules located in separate sections of the Site are an integral part of this offer.
2.4. The Administration recommends that users regularly check the terms of this public offer for changes and/or additions. The user's continued use of the Project after changes and/or additions have been made to this public offer means the user's acceptance and consent to such changes and/or additions.
2.5. The Administration has the right to delete the Account of any User if activity on it (Account Login) has not been registered for more than 1, 3, 6 or 12 months, and whose accounts have been blocked for violating the rules, are deleted with the zeroing of all funds in the accounts. All existing referrals are transferred to the referrer at the level above. If there is no referrer at the level above, then the referrals become free.
2.5.1. After registration, within 7 days, you must activate your account by confirming your registration E-mail. Unconfirmed accounts are deleted after 7 days from the date of registration.
2.6. The Administration is not obligated to train Users to work with the software necessary for interaction with the Project.
2.7. If the User discovers violations/bugs/inaccuracies/errors/cheating methods/methods of bypassing protection in the operation of the Project, he is obliged to inform the Administration about it. The User must not use violations/"bugs"/inaccuracies/errors/cheating methods/methods of bypassing protection in the work of the Project for: obtaining personal benefit or benefit for third parties, disrupting the work of the Project for any purpose, causing any harm to the Administration or any other Users.
2.8. The administrator (including: moderator, assistant) has the right to delete any materials posted by Users without explanation.
2.9. In case of violation of any point of this offer, the user may be issued a warning, a fine, a restriction in using the Project, an Account Ban in the form of a special public entry called a "Black Ticket". The punishment is determined by the Administration, claims and complaints are not accepted.
2.9.1. The Administration independently decides whether to punish or not punish the user, as well as the measures taken as punishment (the type of Black Ticket issued). A User complaining about another User cannot dictate to the Administration what punishment to apply (or not apply) to the offender.
2.9.2. The Administration does not disclose the methods and techniques for identifying violators, as well as the details of identifying specific violations, since disclosure of such information may lead to more effective deception of the Administration by violators.
2.10. In case of blocking the offender's Account, funds are not returned, losses are not compensated. All existing active advertising campaigns are stopped.
2.11. All fees associated with the transfer of funds from or to the Account, for any purpose or direction, are paid by the user.
2.12. The only way to delete an Account at the User’s own request is to personally contact technical support with the obligatory indication of the reason for deletion.
2.13. The Administration does not participate in any disputes between Users, including between the Advertiser and the Contractor. Any disputes between Users, if they do not concern violations of this offer, are resolved by the disputing parties without involving the Administration
2.14. The User agrees to receive technical, informational and advertising materials to the e-mail address specified during registration and other contact information specified in the Account.
2.15. The Administration has the right to restrict the user's access to any of the services or sections of the Project, without explanation.
2.16. The official language of the project is English, all materials and messages posted by users (directly on the Site) must be in English, unless otherwise permitted by the description of the section (instructions, additional rules, explanations).
2.17. By registering on the Site, you agree that if you have a referrer, he can sell you at the fair to another member of the site without your consent and prior notice.
2.18. The User is personally responsible for any information that he/she posts on the Site, communicates to other Users, as well as for any interactions with other Users, carried out at his/her own risk.
2.19. The User, as the owner of the information posted on his/her own personal page, understands that, except for cases established by these Rules and current legislation, the Site Administration does not participate in the formation and use of content and control of access of other users to the User's personal page. By posting information on a personal page, including their personal data, the User understands and agrees that the said information may be available to other Internet users, taking into account the features of the architecture and functionality of the Site.
2.20. The login and password selected by the User are necessary and sufficient information for the User to access the Site. The User has no right to transfer their login and password to third parties, and is fully responsible for their safety, independently choosing the method of storing them.
2.21. The Site Administration may, but is not obligated to, review the Site for prohibited Content and may delete or move (without warning) any Content or users at its sole discretion, for any reason or no reason, including, without limitation, the removal or deletion of Content that, in the personal opinion of the Administration, violates these Rules, the law and/or may violate the rights, cause harm or threaten the safety of other Users or third parties.
3. User Responsibilities:
3.1. When registering and filling out your profile, please provide true information in all fields of the form. Providing false information is a violation and may result in blocking your Account.3.2. To communicate with the Administration, use the internal mail system available on the Site or the feedback page. User requests are considered in the order of the queue.
3.3. The administration has the right not to respond to any person’s request if the request uses materials listed in paragraph 3.5 of this offer.
3.4. In case of any questions related to the use of the Site, the User must contact his Referrer via internal mail for advice, and also be ready to always provide the necessary advice on the work of his Referrals.
3.5. It is prohibited to send "spam", "flood", insults (including veiled), obscene language (including veiled), pornography (including erotica), other obscene messages (materials) in any possible way, in all possible sections of the Project.It is prohibited to use the Site's resources for extortion, threats, begging and other actions that contradict current legislation.
3.5.1. Each user is personally responsible for the messages (materials) they send and their content. The Administration may apply punishment (issue a Black Ticket) and delete messages (materials) if they have obvious signs listed in paragraph 3.5. In all other cases, the Administration has the right not to interfere with communication between Users. The Site Administration is not responsible for the content of messages and materials distributed by Users using the Site's resources.
3.5.2. In case of receiving a complaint from a user, the administrator or moderator may view the user's messages (correspondence) related to this complaint. The user fully agrees with this.
3.6. It is strictly forbidden to register more than one Account! If two or more Accounts are found to be used by one User, all Accounts involved in this violation may receive a Black Ticket up to and including blocking of the Account. The status, reputation, and availability of funds on the balance of the Account of the violator will not be taken into account.
3.7. It is prohibited to register multiple Accounts or log into more than one Account from one computing device. All Accounts involved in this violation may receive a Black Ticket up to and including Account blocking. The status, reputation, and balance of the offender's Account will not be taken into account.
3.8. It is prohibited to use the same registration data (as well as identification data) in more than one Account, including payment system wallet numbers. All Accounts involved in this violation may receive a Black Ticket up to and including blocking of the Account. The status, reputation, and availability of funds on the balance of the Account of the violator will not be taken into account.
3.9. Re-registration of an Account is prohibited if the previous User Account was blocked (issued a Ban) for violating the Project rules. A new Account registered after blocking may receive a Black Ticket until the Account is blocked. The status, reputation, and balance of the offender's Account will not be taken into account.
3.10. It is strictly forbidden to use "cheating" programs ("autoclickers" and/or "autobrowsers" and/or "timer accelerators"). This also applies to any other programs working with the User Account.
3.11. Distribution of the referral link must be organic and appropriate, "spam" in all its forms and manifestations is unacceptable, Users who send their referral links using "spam methods" can receive a Black Ticket up to and including blocking of the Account.
3.12. The User bears full responsibility for the safety of passwords and other identification data (including WMID, social networks, API keys, etc.) used to Login to the Account. The Project provides all necessary and sufficient tools and capabilities to protect the User's Account, any losses incurred as a result of unauthorized access to the Account are not compensated.
3.13. Changing payment details and other User data is only possible in the manner provided by the Project interface in the relevant section of the Account settings; it is not possible to change the details and other User data in any other way.
3.14. It is prohibited to use the services (functions, settings, capabilities) of the Project for other than their intended purpose or not in accordance with the description specified in the relevant sections of the Site.
3.15. The project is not a means of payment, is not an exchange office, there is no function of direct and arbitrary transfer of funds between User Accounts. An attempt to deceive the Administration to carry out such operations and/or carry out such operations is a violation of this user agreement.
3.16. It is prohibited to publish or transfer to other Users (excluding the task execution mechanism itself) reports and control responses to tasks and other advertising campaigns of Advertisers. As well as their use (published or transferred reports and responses, outside the task execution mechanism) for the execution of tasks and other actions provided by the advertising campaign. This clause does not apply to the actions of Advertisers in relation to their own advertising campaigns.
3.17. Sending false reports on task completion may result in a Black Ticket, up to and including Account blocking. The Administration may periodically analyze User reports on task completion to identify violators who do not complete tasks, but nevertheless send reports on their completion.
3.18. It is prohibited to create (distribute, use) methods (methods, software, instructions) intended for cheating (cheating, hacking, disrupting) the Project services. As well as to perform other actions that cause damage to the Project or its Users.
3.19. It is prohibited to distribute false and/or unverified information that causes financial and/or reputational damage to the Project.
3.20. The fact that the customer uses the Project services is private information (only for the Users of the project), unless otherwise explicitly provided by the service. Disclosure of this information (or threats of such disclosure) to third parties is a violation and may result in a Black Ticket, up to and including blocking of the Account.
4. Responsibilities of advertisers:
4.1. Advertisers are fully responsible for the content of the resources they advertise and for the materials used to carry out advertising campaigns. Any damage, including material, associated with an incorrectly completed order, the content of advertising materials, or the use of non-working links, is not compensated.4.2. Advertising of the following Internet resources is prohibited:
— containing viruses or phishing sites/links;
— containing unwanted software installed without explicit warning or consent of the user;
— blocked Yandex Safe Browsing or Google Safe Browsing;
— containing programs/materials/services for hacking software/Websites/Protected systems/Accounts, as well as any resources related to hacking/hacking;
— outright fraudulent sites;
— containing pornography (for any type of order) or erotic materials (for direct display: visits, surfing, letters, banners, etc.);
— resources with services/goods/materials of an intimate nature, dating sites for one night and the like, and other resources "for adults" in an intimate sense;
— calling for violence, racism, nationalism, immoral behavior, criminal acts;
— political, religious, acute social;
— resources for collecting donations, other than official funds and aid centers;
— sites that disrupt the normal functioning of the Project or its individual parts and software modules;
— sites "not for people", with a large amount of advertising, pop-up windows, "heavy" content, etc.;
— taking an unreasonably long time to load, regardless of the reason;
— violating current legislation.
4.2.1. If any Internet resource/material (not included in the list from paragraph 4.2.), used by the Advertiser in its advertising campaigns, is potentially capable of causing negative consequences in the work of the Project, then the Administrator has the right to prohibit/block the use of such Internet resources/materials (both at the level of an individual Advertiser and at the level of the entire Project), including in the form of issuing a Black Ticket of the "Ban" type.
4.2.2. In case of repeated use of an Internet resource/material (not included in the list from paragraph 4.2.), prohibited by the Administrator, the Advertiser may receive a Black Ticket up to and including blocking of the Account.
4.3. If the Advertiser places information about goods or services for which there are rules and restrictions, then he is obliged to have all the necessary permits, licenses or certificates and provide copies of them within three days upon request of the Administration.
4.4. The Advertiser may not use, when conducting an advertising campaign, appeals on behalf of the Administration or on behalf of any of the Users (except for his own name), or mislead Users regarding the process of viewing the advertised site (completing the task) and receiving a reward for this viewing (completing the task).
4.5. It is prohibited to post tasks that require sending paid SMS messages (or other payments) whose cost exceeds the reward for completing the task (the exception is the "investments" and "transfer" sections), as well as tasks in the report of which it is necessary to provide data for accessing personal Accounts or other personal payment data.
4.6. It is prohibited to place advertising campaigns, indicating incorrect data and settings that lead to the impossibility of automatic payment, or otherwise disrupt the operation of the Project.
4.7. It is prohibited to create tasks with obviously impossible conditions or those that cannot be fulfilled within the time allotted in the task. It is prohibited to check and pay for the task outside the Project mechanism. It is prohibited for the task conditions to require the execution of any actions before pressing the "Start execution" button; all actions in the task must be performed after creating the request (pressing the "Start execution" button).
4.8. It is forbidden to create identical (or almost identical) tasks. It is forbidden to create several tasks if they can be replaced by one reusable task.
4.9. It is forbidden to create "negative" tasks (advertising campaigns): negative/negative comments and materials, dislikes (negative ratings), comments/materials with insults, sending complaints about anything and other similar "negative" actions.
4.10. It is prohibited to request/use user details in a way that is not controlled by them. For example, request a phone number from the performer, and then ask to send the text of the SMS message received on his number.
4.11. Tasks that, when completed, may result in the performer incurring debt obligations are prohibited.
4.12. Tasks that contain in their conditions the transfer of funds directly from the performer to the customer in payment systems (for example: payeer, etc.) are prohibited.
4.13. Advertising campaigns can be stopped at any time and sent for moderation to check for compliance with the project rules. Moderation can last up to 7 working days (or longer in non-standard cases).
4.14. In dynamic links/surfing and advertising letters, advertising that has received 10 complaints from users is automatically removed and sent for verification by the site moderation. If the complaints are unfounded, the link will resume its display, but if the complaints are confirmed, the advertising is removed without a refund.
5. Financial relations:
5.1. The Project has 2 internal User balances, an "advertising balance" and a "main balance". All of the Contractor's rewards for completing tasks and other actions are credited to the main account, funds from which the User can withdraw to their wallets in payment systems. The advertising account is used to order services, it can only be replenished, funds cannot be withdrawn from it!5.2. The advertising account is replenished automatically using the appropriate payment system tools (Payeer). As soon as the Project receives a payment notification from the payment system, your advertising account is instantly replenished, and you can order certain services. The advertising account can be replenished only through the account replenishment page in the user's personal account (an application for replenishment is created). No direct payments, without such an application, are credited to the Project wallets to the advertising account.
5.3. Obligations to pay for and provide the Service are considered fulfilled from the moment funds are credited to the account of the Site "clikmanbux.com" and the activation of the relevant technical, information and other resources of the System.
5.4. In case of transfer of funds to pay for the Services of the Site "clikmanbux.com", the commission of the payment system is covered by the Party making the payment.
5.5. Settlements between Participants are made between the Customer and the Contractor via the website “clikmanbux.com”.
5.6. Withdrawal of funds from the main balance is instant.
5.7. Withdrawal of funds from the main account is carried out in accordance with the current tariffs indicated on the Site and includes all expenses of the Site "clikmanbux.com" for the execution of the order.
5.8. The Project does not represent either the Advertisers who publish their orders on the Site ("Tasks", "visits", "letters", etc.), or the Performers who fulfill these orders in full or in part, and therefore cannot be held responsible for any financial obligations arising between the two. Any agreements between Advertisers and Performers using the Site are bilateral, and the Project has nothing to do with them.
5.9. The Site has the right to block the User's access to the System at any time due to the User's violation of the offer and other documents regulating the Site's operation. The Site "clikmanbux.com" does not provide reimbursement of funds and other expenses.
6. Other conditions:
6.1. The Project Administration does not guarantee permanent or unconditional access to the services provided. The functioning of the project may be disrupted by force majeure and other factors, the prevention or overcoming of which is beyond the capabilities of the Project Administration.6.2. The Project is provided “as is”, the Project Administration is not responsible for the fact that the results that may be obtained when using the Project will not meet the goals and expectations of its users.
6.3. The Project Administration shall not be liable for any direct or indirect damages arising from the use or inability to use the Project, or as a result of unauthorized access to the user's communications.
6.4. The Project Administration is not responsible for any contracts and agreements between Users. It does not act as a guarantor for any contracts, transactions and relations between Users. It does not regulate or participate in personal disputes between users.
6.5. The Site Administration shall not be liable to third parties for the content of information used in the information materials posted by the Advertiser, or for property, moral or any other damage caused as a result of the use of said information by third parties.
6.6. If any conditions of the service are not specified in this offer or are not described on the pages of the site, you should contact the Administration for clarification and follow the instructions that the Site Administration gives.
